Generally, the counting of days will exclude the settlement date but include the day on which the notice is to be given. On this basis, the notice may be given up to and including 20 April. This is consistent with the approach to counting of days for phrases such as “x days after” a date or event.

“Within” refers to the 30 days after the start date. Therefore whatever it is that needs completion must be completed BEFORE the 30 days are up.

“Within” means that the event / object / subject can happen / occur on Day 1, Day 2, Day 3, Day 4, OR Day 5. Example: You friend borrows $10 to get gas, and tells you he'll pay you back “within 5 days”. He then pays you back on Day 3. “In” means that the thing will happen ON Day 5.

Thus, a Business Day begins at 8:00 AM and ends the next Business Day at 7:59 AM. Secondly, the first Business Day begins at 8 AM of the first Business Day following the date of final contract acceptance. Thirdly, a Business Day may not begin or end on a Saturday, Sunday of Federal Holiday.

Counting Calendar Days for Contingencies

Count “days 'after” the contract start date (example: contract start date is 6/2/18, so day one is 6/3/18, day two is 6/4/18… day 17 is 6/19/18). Weekends and holidays are included in the counting.

When counting a timeline, the day of the event is not counted, the next day is counted as one, and the last day is included in the count.

Unless otherwise specified, most people would interpret the word "days" in a contract to mean calendar days. This is one reason why people usually define terms like business days to also exclude specific holidays and things like that.

Normally, it is 10 calendar days unless the last day falls out on a weekend or holiday.

FAR 2.101 succinctly says: “Day means, unless otherwise specified, a calendar day.” Applying the FAR provisions in question, the ASBCA wrote that “there is only one reasonable way to interpret the contract.” FES's “opinion that 'day' should mean 'work day' is not a reasonable interpretation of the contract.”

Count every day after the filing date, including weekends, holidays, and the last day of the period. If the last day of the period is a Saturday, Sunday, holiday, or court closure, the period continues to run until the next day that is not a Saturday, Sunday, holiday, or court closure.

"Days" refers to calendar days, not court days, and does not factor in holidays or weekends, unless the last day you can do something falls on a weekend or holiday. When counting "days" here, you start on the day after the triggering event and then include the last day as the 10th day.

three months means the period of time between a certain day and the same date of the following third consecutive month of the calendar, inclusive, unless in such third month that date does not exist, in which case it shall end on the last day of that third month. three months means three 'calendar' months or 88 days.
